THUEMMEL UHLE & EDER ARE EXPERTS IN PERSONAL INJURY LAW
MOTOR VEHICLE / CAR ACCIDENTS
Motor vehicle/car accident injuries happen when you are the driver or passenger in a motor vehicle that is struck by another motor vehicle on a public road. These accidents may range from a rear-end accident to a T-bone collision. Whether the accident is minor or is significant, the injuries that you have suffered are real and can take months to years to heal.
Under Oregon law, automobile insurance policies are required to include a minimum amount of personal injury protection (PIP) so that you can begin medical treatment immediately for the injuries you suffered in the accident. The process for obtaining these benefits should be straightforward, but these insurance companies have made the process overly complex. We can help you navigate this process to ensure that you receive the benefits for which you are legally entitled to receive. Once those benefits have been properly paid and exhausted, we work to get your other past medical bills, future care, lost wages, emotional distress and pain and suffering paid through the liability limits and underinsured/uninsured motorist limits in the negligent driver’s and your own insurance company’s policies.
DOG BITES
These injuries happen when you are bitten without warning by someone else’s dog. We can help you pursue the dogs’ owners and their insurance companies to help get you compensated for your medical treatment, wage loss, impacts on daily life activities and pain and suffering caused by the bite(s).
MEDICAL MALPRACTICE
These injuries happen when a medical professional, such as a doctor or nurse, fails to uphold the standard of care in your medical treatment and you are injured as a result. The injuries sustained as a result of medical malpractice can be significant and lifelong. We can help you pursue these medical providers and their insurers to help you obtain the money that you require to recover from your injuries, reimburse you for your lost wages and compensate you for the impact on your life and your pain and suffering.

BICYCLE ACCIDENTS
Bicycle accident injuries happen while you are a bicyclist, and they may result from a motor vehicle collision, conditions of the roadway or sidewalk or other hidden or dangerous conditions that you encounter. If you have your automobile insurance, you may be able to access the personal injury protection (PIP) benefits under your automobile insurance policy to begin medical treatment immediately. You may also pursue PIP benefits through the wrongful driver’s insurance policy. We can assist you in pursuing the wrongful parties’ insurance, and to the extent necessary, your own insurance policy to cover your past medical bills, future care, lost wages, impact on your daily life activities and pain and suffering. The vehicle code has some different obligations for cyclists in comparison to motor vehicles.
SLIP-AND-FALL /TRIP-AND-FALL (PREMISES LIABILITY)
Injuries may happen at businesses and other properties where you are an invitee. These locations may include, for example, the inside of a restaurant or grocery store, on the sidewalk outside of someone’s home or business or on the property of another commercial business or residential property. Injuries at these locations may arise when you slip and fall, trip and fall or are otherwise hurt when the owners and/or managers of these premises fail to keep those premises reasonably safe and you are injured. We can assist you in pursuing those premises and their insurers for your damages, including but not limited to, your past medical bills, future care, lost wages and pain and suffering.
PEDESTRIAN ACCIDENTS
Pedestrian accidents and resulting injuries happen when you are walking, running or otherwise traveling by foot and are hit by motor vehicle, bicycle or other non-motorized method of travel. If you have your automobile insurance, you may be able to access the personal injury protection (PIP) benefits under your policy to begin medical treatment immediately. You may also pursue PIP benefits through the wrongful driver’s insurance policy. We can assist you in pursuing the wrongful parties’ insurance, and to the extent necessary, your own insurance policy to cover your past medical bills, future care, lost wages and pain and suffering.

WRONGFUL CONCEPTION/BIRTH
Wrongful conception/birth may occur for multiple reasons, including but not limited to, failures by a fertility specialist to provide the correct genetic material during an intrauterine insemination (IUI) or by a physician for failing to timely diagnose serious medical conditions in an embryo or fetus. Even though a parent continues to unconditionally love their child, the impacts from a wrongful birth are substantial and may require lifelong medical treatment, therapy and counseling, caregivers and/or other costs related to raising the child. We can help you pursue a claim against these negligent medical providers to help you raise wrongfully conceived/birthed children, as well as to help compensate you for the emotional distress
CONSTRUCTION SITE INJURIES
An employee’s lost wages and medical treatment may be covered by the employee’s direct employer/insurer on a construction site under Oregon’s Workers’ Compensation scheme – generally known as the exclusive remedy rule. Under Oregon’s Employer Liability Law, however, others on the project who maintained the right to control a dangerous activity may be held liable for the employee’s injuries caused by that dangerous activity. We can help you with your pursuit of your workers’ compensation claim against your insurer to help cover your time loss and to obtain the medical treatment you require from your injuries sustained on the work site. We can also help you with your claim against the general contractor, owner or manager of the worksite to help cover your damages that are unavailable under the Workers’ Compensation law, such as those damages for the impact on your daily life and your pain and suffering as a result of the injuries.
WRONGFUL DEATH
When a loved one dies as a result of a tragic motor vehicle accident, bicycle accident, medical procedure, construction site or other incident where someone else is responsible, a tremendous void is left in the family. These losses include not only the loss of the decedent’s companionship, but also the economic losses in the form of lost earnings from the decedent and the costs to replace the decedent’s services around the household. We can help you pursue a claim on behalf of the decedent’s estate that will help cover these losses, as well as any pain and suffering that the decedent may have experienced prior to their untimely passing.
